Agreement to Terms

By downloading, installing, or using StepMuse ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Minute Long Solutions, LLC ("Company," "we," "us," or "our") regarding your use of the App.

App Description

StepMuse is a mobile application that transforms your daily step count into musical compositions. The App:

• Connects to Apple HealthKit to access your step count data
• Generates unique musical melodies based on your daily activity
• Provides various instruments and musical styles for personalization
• Offers challenges and achievements to encourage fitness
• Allows sharing and export of generated melodies

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App on your iOS device for personal, non-commercial purposes.

License Restrictions

You may not:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose without written permission
• Remove or alter any proprietary notices or labels
• Use the App in any way that violates applicable laws or regulations

User Responsibilities

As a user of StepMuse, you agree to:

Health Data and Privacy

StepMuse accesses your health data through Apple HealthKit. By using the App, you acknowledge and agree that:

• You grant the App permission to read your step count data from HealthKit
• All health data processing occurs locally on your device
• We do not collect, store, or transmit your health data to external servers
• You can revoke HealthKit permissions at any time through iOS Settings
• Your health data remains under your control and can be deleted by uninstalling the App

Intellectual Property

The App and its original content, features, and functionality are owned by Minute Long Solutions, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

User-Generated Content

Any melodies, compositions, or other content you create using the App ("User Content") remains your property. By using the App, you grant us a limited license to process your User Content solely for the purpose of providing App functionality.

Trademarks

"StepMuse" and related marks are trademarks of Minute Long Solutions, LLC. You may not use our trademarks without our prior written consent.

Prohibited Uses

You may not use StepMuse:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• For any obscene or immoral purpose
• To interfere with or circumvent the security features of the App

Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranty that:

• The App will meet your requirements
• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from the use of the App will be accurate or reliable
• Any errors in the App will be corrected

Health and Fitness Disclaimer

StepMuse is designed for entertainment and motivation purposes. It is not intended to provide medical advice, diagnosis, or treatment. Always consult with a healthcare professional before making changes to your exercise routine or if you have concerns about your health.

Limitation of Liability

IN NO EVENT SHALL MINUTE LONG SOLUTIONS, LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

Our total liability to you for any damages arising from or related to these Terms or the App shall not exceed the amount you paid for the App, if any, or $100, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless Minute Long Solutions, LLC and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the App will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.

Governing Law

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
