Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Minute Long Solutions ("we," "our," or "us") regarding your use of the Prefero mobile application (the "App"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the App.

Description of Service

Prefero is a decision-making application that presents users with thought-provoking dilemmas between immediate and gradual returns. The App allows users to:

  • Make decisions on various scenarios
  • Track decision history and statistics
  • Create custom dilemmas (premium feature)
  • Access advanced proof analysis (premium feature)

Eligibility

You must be at least 13 years old to use Prefero. By using the App, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations

User Accounts

Prefero does not require user accounts. The App operates entirely locally on your device without requiring registration or login.

In-App Purchases

Custom Dilemma Creation Credits

  • Product: 3 Dilemma Credits Pack
  • Price: $0.99 USD (or equivalent in local currency)
  • Type: Consumable purchase
  • Description: Each purchase provides 3 credits that can be used to create custom dilemmas. Credits are consumed when you create a dilemma. Credits do not expire.

Advanced Proof Analysis Subscription

  • Monthly Subscription: $2.99 USD/month (or equivalent in local currency)
  • Yearly Subscription: $9.99 USD/year (or equivalent in local currency)
  • Type: Auto-renewing subscription
  • Description: Provides access to advanced NLP analysis, detailed mathematical verification, and comprehensive decision insights.

Subscription Terms

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your Apple ID Account Settings
  • No refunds will be provided for any unused portion of a subscription period

Purchase Processing

  • All purchases are processed by Apple through the App Store
  • Prices are displayed in your local currency
  • Apple's terms and conditions apply to all transactions
  • Refunds are subject to Apple's refund policy

User Content

Custom Dilemmas

  • You may create custom dilemmas using the App's creation features
  • You retain all rights to content you create
  • You are solely responsible for the content of your custom dilemmas
  • We do not claim ownership of your custom dilemmas

Prohibited Content

You agree not to create dilemmas that:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Contain hate speech, harassment, or discriminatory content
  • Are pornographic, obscene, or sexually explicit
  • Promote illegal activities
  • Contain malware or malicious code

Intellectual Property

Our Rights

  • Prefero and all content, features, and functionality are owned by Minute Long Solutions
  • The App is protected by copyright, trademark, and other intellectual property laws
  • You may not copy, modify, distribute, sell, or lease any part of the App

Your Rights

  • You retain ownership of custom dilemmas you create
  • You may use the App for personal, non-commercial purposes
  • You may share screenshots or proof documents generated by the App

Acceptable Use

You agree to use Prefero only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates applicable laws
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Use the App to transmit any viruses or malicious code
  • Interfere with or disrupt the App's functionality

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF RESULTS

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or other harmful components

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, DATA, OR USE
  • PERSONAL INJURY OR PROPERTY DAMAGE
  • ANY DAMAGES RESULTING FROM USE OR INABILITY TO USE THE APP

Our total liability shall not exceed the amount you paid for in-app purchases in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Minute Long Solutions from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you create in the App

Termination

By You

  • You may stop using the App at any time
  • You may delete the App from your device
  • Cancelling subscriptions does not terminate these Terms

By Us

We may terminate or suspend your access to the App immediately, without prior notice, if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Use the App in a manner that could harm us or other users

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms in the App
  • Updating the "Last Updated" date
  • Providing notice through the App Store (if required)

Your continued use of the App after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Minute Long Solutions operates, without regard to conflict of law principles.

Dispute Resolution

Informal Resolution

If you have a dispute with us, you agree to first contact us at [email protected] to attempt to resolve the dispute informally.

Binding Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

Apple-Specific Terms

If you downloaded the App from the Apple App Store:

  • These Terms are between you and us, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide support for the App
  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable)
  • Apple is not responsible for addressing any claims relating to the App
  • Apple is a third-party beneficiary of these Terms

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and Minute Long Solutions regarding the App and supersede all prior agreements and understandings.
