These Terms of Service constitute a legally binding agreement between you and Minute Long Solutions regarding your use of the Orb Dash mobile application.

Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Minute Long Solutions ("we," "our," or "us") regarding your use of the Orb Dash mobile application (the "App"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the App.

Description of Service

Orb Dash is a mobile arcade-style game application available for iOS devices. The App provides:

  • Seven unique game modes (Endless, Time Attack, Avoid Color, Collect Color, Evade All, Score Challenge, Color Changes)
  • Customizable gameplay settings and difficulty levels
  • Statistics tracking and achievement system
  • Multiplayer features through Apple GameCenter and SharePlay
  • Avatar customization and sound unlock system
  • Comprehensive game statistics and progress tracking

Eligibility

You must meet the following requirements to use the App:

  1. Age Requirement: You must be at least 4 years old to use the App (as indicated by the App Store age rating)
  2. Device Compatibility: You must have a compatible iOS device running iOS 17.0 or later
  3. Legal Capacity: You must have the legal capacity to enter into binding agreements in your jurisdiction
  4. Parental Consent: If you are under 18 (or the age of majority in your jurisdiction), you represent that you have obtained parental or guardian consent to use the App

User Accounts

No Account Required

The App does not require you to create an account. However, certain features may require:

  • GameCenter: Multiplayer features may require an Apple GameCenter account, which is subject to Apple's Terms of Service
  • SharePlay: SharePlay features require an active FaceTime call and are subject to Apple's Terms of Service

Account Responsibility

If you choose to use GameCenter or SharePlay features, you are responsible for:

  • Maintaining the confidentiality of your Apple ID and GameCenter credentials
  • All activities that occur under your account
  • Ensuring that your account information is accurate and up to date

In-App Purchases

Available Purchases

The App offers the following in-app purchases:

  1. Emoji Milestones Unlock ($0.99 one-time)
    • Unlocks all emoji avatar milestones instantly
    • Product ID: com.minutelongsolutions.Orb-Dash.emoji_milestones
  2. Rocket Ships Unlock ($0.99 one-time)
    • Unlocks all rocket ships and player rocket instantly
    • Product ID: com.minutelongsolutions.Orb-Dash.rocket_unlock
  3. Projectile Clues ($0.99 one-time)
    • Reduces projectile unlock time requirement to 30 days
    • Product ID: com.minutelongsolutions.Orb-Dash.projectile_clues
  4. Remove Ads (One-Time) ($4.99 one-time)
    • Permanently removes all advertising from the App
    • Product ID: com.minutelongsolutions.Orb-Dash.remove_ads_onetime
  5. Remove Ads (Subscription) ($1.99/month)
    • Removes all advertising with monthly auto-renewing subscription
    • Product ID: com.minutelongsolutions.Orb-Dash.remove_ads_subscription
    • Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
    • You can manage subscriptions in your Apple ID account settings

Purchase Terms

  • All purchases are processed through Apple's App Store
  • All purchases are subject to Apple's Terms of Service and Payment Terms
  • Prices are displayed in your local currency and may vary by region
  • Purchases are final and non-refundable unless required by law or as specified in Apple's refund policy
  • Subscription purchases will auto-renew unless cancelled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions through your Apple ID account settings
  • We reserve the right to modify, suspend, or discontinue in-app purchases at any time
  • Purchase status is stored locally on your device and may be lost if you delete the App

Advertising

The App displays advertising through Google Mobile Ads (AdMob). Advertising may appear:

  • After game completion (interstitial ads)
  • At other points during app usage

You can remove all advertising by purchasing either:

  • Remove Ads (One-Time) for permanent ad removal
  • Remove Ads (Subscription) for subscription-based ad removal

We do not control the content of third-party advertisements. Ad content is provided by Google's advertising network and is subject to Google's advertising policies.

Intellectual Property Rights

Our Rights

The App, including its original content, features, functionality, design, graphics, code, and all related intellectual property, is owned by us and protected by copyright, trademark, and other intellectual property laws.

Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on compatible iOS devices
  • Use the App for personal, non-commercial entertainment purposes
  • Access and use the App's features as intended

Restrictions

This license does not include the right to:

  • Copy, modify, or distribute the App
  • Use the App for commercial purposes
  • Create derivative works based on the App
  • Remove proprietary notices or labels
  • Transfer or sublicense your rights

User Content and Data

Your Data

You retain ownership of any data you generate while using the App (game statistics, settings, preferences). However, you grant us a license to:

  • Store your data locally on your device
  • Use your data to provide App functionality and features
  • Process your data in accordance with our Privacy Policy

Data Deletion

You can delete your data at any time by:

  • Deleting the App from your device
  • Resetting settings through the App's Settings screen
  • Clearing game statistics (by deleting and reinstalling the App)

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  1. Violate Laws: Use the App in any way that violates any applicable local, state, national, or international law or regulation
  2. Harm Others: Use the App to harm, threaten, or harass others
  3. Reverse Engineer: Attempt to reverse engineer, decompile, disassemble, or otherwise derive source code from the App
  4. Modify the App: Attempt to modify, adapt, alter, or create derivative works of the App
  5. Remove Notices: Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  6. Interfere with Service: Interfere with or disrupt the App's functionality or servers
  7. Automated Access: Use automated systems (bots, scripts) to access or interact with the App
  8. Exploit Bugs: Exploit bugs, glitches, or vulnerabilities in the App for personal gain
  9. Impersonation: Impersonate others or provide false information
  10. Spam or Abuse: Engage in any form of spam, abuse, or harassment in multiplayer features

Multiplayer Features

GameCenter

When using GameCenter features:

  • You must comply with Apple's GameCenter Terms of Service
  • You are responsible for your conduct in multiplayer sessions
  • We are not responsible for the actions of other players
  • We reserve the right to restrict or ban users who violate these Terms

SharePlay

When using SharePlay features:

  • You must comply with Apple's SharePlay Terms of Service
  • SharePlay requires an active FaceTime call
  • You are responsible for your conduct during SharePlay sessions
  • We are not responsible for the actions of other participants

Disclaimers

No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY, RELIABILITY, OR AVAILABILITY
  • UNINTERRUPTED OR ERROR-FREE OPERATION

Service Availability

We do not guarantee that:

  • The App will be available at all times
  • The App will be free from errors, bugs, or interruptions
  • The App will meet your specific requirements
  • Data will be preserved in all circumstances

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  1. Indirect Damages: Any indirect, incidental, special, consequential, or punitive damages
  2. Data Loss: Loss of data, game statistics, or progress
  3. Service Interruption: Interruptions or cessation of the App
  4. Third-Party Actions: Actions of other users in multiplayer features
  5. Device Damage: Any damage to your device resulting from use of the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY) OR $0.00 IF THE APP IS FREE.

Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your conduct in multiplayer features

Termination

By You

You may stop using the App at any time by:

  • Deleting the App from your device
  • Discontinuing use of the App

By Us

We reserve the right to:

  • Suspend or terminate your access to the App at any time, with or without cause
  • Remove or disable access to the App for users who violate these Terms
  • Modify, suspend, or discontinue the App or any part thereof at any time

Effect of Termination

Upon termination:

  • Your right to use the App will immediately cease
  • Your data may be deleted (if stored on our servers, which it currently is not)
  • All provisions of these Terms that by their nature should survive will survive

Updates and Modifications

App Updates

We may update the App from time to time to:

  • Add new features or functionality
  • Fix bugs or security issues
  • Improve performance or user experience
  • Comply with legal requirements

Terms Updates

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Updating the "Last Updated" date
  • Posting notice in the App (if applicable)
  • Providing notice through the App Store update process

Your continued use of the App after changes constitutes acceptance of the updated Terms.

Governing Law and Dispute Resolution

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

Apple-Specific Terms

The following terms apply to the iOS version of the App:

App Store Terms

  • Your use of the App is also subject to Apple's App Store Terms of Service
  • The App is licensed, not sold, to you
  • Apple is not a party to these Terms and has no obligation to provide support

Apple's Standard End User License Agreement

To the extent these Terms conflict with Apple's Standard End User License Agreement, Apple's terms shall govern with respect to App Store-related matters.

Acknowledgment

You acknowledge that:

  • These Terms are between you and us, not Apple
  • Apple has no obligation to provide maintenance or support
  • Apple is not responsible for addressing any claims relating to the App
  • Apple is not responsible for product liability claims

Changes to Service

We reserve the right to:

  • Modify or discontinue the App or any part thereof
  • Change features, functionality, or content
  • Impose limits on certain features or restrict access
  • Update system requirements

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters
  • War, terrorism, or civil unrest
  • Internet or telecommunications failures
  • Government actions or regulations
  • Acts of third parties

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
