1. AGREEMENT TO TERMS

By accessing or using the Fam Gift application ("App"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

2. PRIVACY POLICY

Your use of the App is also subject to our Privacy Policy, which describes how we collect, use, and share information about you when you use the App.

3. CHANGES TO TERMS OR APP

We may modify the Terms at any time, at our sole discretion. If we do so, we'll let you know by posting the modified Terms in the App or through other communications. It's important that you review the Terms whenever we modify them because if you continue to use the App after we have posted modified Terms, you are indicating to us that you agree to be bound by the modified Terms.

4. ACCOUNT REGISTRATION AND SECURITY

To use certain features of the App, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.

5. PAYMENT PROCESSING

Fam Gift facilitates gift contributions through third-party payment processors including Apple Pay, Zelle, PayPal, and CashApp. All payments are processed by these third-party providers, and Fam Gift does not store your full payment information.

By using the App, you agree to:

• Comply with the terms and conditions of your chosen payment provider
• Authorize payments only for legitimate gift contributions
• Understand that refunds are subject to the policies of your payment provider
• Accept that Fam Gift is not responsible for payment processing errors or disputes

6. USER CONTENT AND CONDUCT

The App may allow you to post, upload, publish, submit, or transmit content, including family information, gift details, and messages. You retain all rights in any content you submit, post, or display on or through the App.

You agree that you will not post, upload, publish, submit, or transmit any content that:

• Violates any applicable law or regulation
• Infringes any third party's intellectual property or other rights
• Contains harmful, abusive, obscene, or offensive content
• Contains false or misleading information
• Contains software viruses or any other computer code designed to interfere with the functionality of the App

7. LICENSES

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App on your compatible devices for your personal, non-commercial use.

8. COPYRIGHT POLICY

We respect the intellectual property of others and ask you to do the same. We may terminate users who repeatedly infringe the intellectual property rights of others.

9. TERMINATION

We may terminate or suspend your account and bar access to the App at our sole discretion, without prior notice or liability, under our sole discretion, for any reason whatsoever, including, but not limited to, a breach of the Terms.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, in no event shall Fam Gift, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.

11. GOVERNING LAW

These Terms and your access to and use of the App will be governed by and construed and enforced in accordance with the laws of the United States, without regard to conflict of law rules or principles.

12. ENTIRE AGREEMENT

These Terms constitute the entire agreement between us regarding our App, and supersede and replace any prior agreements we might have between us regarding the App.
