1. Acceptance of Terms

By downloading, installing, or using the Shot Glass mobile application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Shot Glass is a mobile application designed to help users track their alcohol consumption. The App provides features including:

  • Alcohol consumption logging
  • Blood alcohol content (BAC) estimation
  • Consumption analytics and tracking
  • Personal limit setting and monitoring

3. Age Restrictions

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you are at least 18 years of age.

4. Medical Disclaimer

IMPORTANT: Shot Glass is not a medical device and should not be used as a substitute for professional medical advice, diagnosis, or treatment. The BAC estimates and other information provided by the App are for informational purposes only and may not be accurate for all individuals.

Never rely solely on the App's estimates for decisions about driving, operating machinery, or other activities that could be dangerous under the influence of alcohol. Always err on the side of caution and never drive under the influence of alcohol.

5. Responsible Use

Shot Glass is designed to promote responsible alcohol consumption. The App is not intended for use by individuals with alcohol dependency or addiction. If you believe you may have a problem with alcohol, please consult with a healthcare professional.

6. User Responsibilities

You are responsible for:

  • Providing accurate information about your weight, gender, and other personal factors
  • Using the App responsibly and in accordance with applicable laws
  • Not using the App while operating a vehicle or machinery
  • Seeking professional help if you have concerns about your alcohol consumption

7. Privacy and Data

All data you enter into the App remains on your device and is not transmitted to our servers. We do not collect, store, or access your personal consumption data. Please refer to our Privacy Policy for more information.

8. Intellectual Property

The App and its original content, features, and functionality are owned by Minute Long Solutions, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Prohibited Uses

You may not use the App:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information
  • To upload or transmit viruses or any other type of malicious code

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

IN NO EVENT SHALL MINUTE LONG SOLUTIONS, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

12. Indemnification

You agree to defend, indemnify, and hold harmless Minute Long Solutions, LLC and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

15. Governing Law

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
